PF, ESI and PT for seasonal sugar mill workers
PF applies to seasonal sugar workers from the date of joining, with mandatory cover now up to wages of Rs 25,000 a month, while ESI excludes a seasonal factory, which by definition includes one exclusively making sugar. Professional tax is a state levy, so it depends on where the mill stands, and a mill with a distillery should take advice before treating itself as outside ESI.
What changed in law
The provident fund and ESI provisions of the older Acts moved into the Code on Social Security, 2020 from 21 November 2025. The Employees' Provident Funds Scheme, 2026 and the matching pension and EDLI schemes followed, dated 29 June 2026. EY reports Gazette publication on 1 July.
Older circulars and HR manuals may still cite the 1952 Act and the 1948 Act. Update your references, and check any saved position with your adviser.
PF for seasonal staff
Chapter III of the Code applies to establishments with 20 or more employees. We found no separate seasonal carve-out in the published text of the EPF Scheme, 2026. An employee covered by the scheme becomes a member from the date of joining.
The wage ceiling is now Rs 25,000 a month, under S.O. 5109(E) of 17 September 2026. EPFO's FAQs say employees up to that wage are mandatorily covered by EPF, EPS and EDLI. Those already members stay members if wages later rise above it.
Two definitions matter for a mill. Under the Code, wages include basic pay, dearness allowance and retaining allowance, if any. So review how you treat off-season retention pay. The definition also adds back excluded allowances above half of total remuneration, so a seasonal pay structure with low basic needs checking.
| Item | Rate | At Rs 25,000 wages |
|---|---|---|
| Employee PF | 12% | Rs 3,000 |
| Employer to EPS | 8.33% | Rs 2,082.50 before rounding |
| Employer to EPF | 3.67% | Rs 917.50 before rounding |
| EDLI | 0.5% | Rs 125 |
| Admin charges | 0.5% | Rs 125 |
Pension service for seasonal workers
An EPFO booklet on the 1995 pension scheme said a year of seasonal contributory service counts as a full year for eligibility, and listed sugar among seasonal industries. We could not confirm the same wording in the Employees' Pension Scheme, 2026. Ask your PF consultant before you advise staff.
One recent change does not affect your payroll figure. G.S.R. 890(E) of 15 October 2026 limits the Central Government's own pension contribution to wages up to Rs 15,000. The employer's EPS share still follows the scheme.
ESI and the seasonal factory rule
Chapter IV of the Code covers establishments with ten or more persons, other than a seasonal factory. Section 2(74) defines a seasonal factory as one exclusively engaged in listed processes, including sugar and gur, or any process incidental to or connected with them.
That word exclusively is where a modern mill needs care. A distillery, cogeneration plant, refinery or year-round packing unit may raise a question. We could not find a recent ESIC or High Court ruling that settles this for sugar units. Get a written view on your own plant, and also on separate offices and depots.
If ESI applies, the rates are 3.25% from the employer and 0.75% from the employee, on wages up to the Rs 21,000 limit still applied in practice. Taxmann reports that no ceiling has yet been notified for Chapter IV. Contributions fall due within 15 days of the month end. ESIC's contribution periods run from April to September and October to March.
Professional tax by state
Article 276 of the Constitution caps the tax at Rs 2,500 a year. States set slabs and dates, and published summaries conflict. Check your state portal before relying on any figure below.
| State | Position |
|---|---|
| Maharashtra | Top slab reported at Rs 200 a month and Rs 300 in February. A February 2026 change reportedly moved return dates to the 15th. Confirm on mahagst.gov.in. |
| Karnataka | Levied monthly. Sources report a Rs 25,000 monthly threshold from April 2025. |
| Tamil Nadu | Collected half-yearly by local bodies. |
| Gujarat | Levied. Sources report a Rs 12,000 monthly threshold. |
| Andhra Pradesh, Telangana | Levied monthly above reported Rs 15,000. |
| Madhya Pradesh | Levied. Published schedules conflict, so check the state source. |
| Uttar Pradesh | Listed as not levying professional tax. |
Contract gangs
The EPF Scheme, 2026 makes the principal employer responsible for contract workers' contributions where the contractor is not separately registered. KPMG reports Form X to declare contractors, Form XI from the contractor within 10 days of month end, and Form XII from the principal employer within 20 days. Decide early who files for each gang.
Season checklist
- Enrol each joiner from the joining date, with UAN.
- File the ECR and pay within 15 days of month end.
- Separate seasonal, permanent and contract staff in payroll.
- Review retention pay against the Code's wage definition.
- Test pay structures against the 50% rule.
- Record your ESI position in writing, by unit.
- Test each month's pay against the state PT slab.
- Collect contractor challans monthly.
Running the payroll
SugarOS, a sugar mill ERP, keeps permanent, seasonal and contract staff in one master, with gang muster, a separate seasonal retention run, and PF ECR, ESI and PT files read from payslips. ESI is a setting per plant, and Maharashtra's PT slabs are preloaded.
This is general information, and this area is changing quickly. Confirm your position with your PF and ESI officers, accountant or labour counsel.
Frequently asked questions
Is a sugar factory exempt from ESI?
A factory exclusively engaged in sugar, or processes incidental to it, falls within the seasonal factory definition, and ESI excludes seasonal factories. Mixed units should take written advice.
Do seasonal workers get PF from day one?
The EPF Scheme, 2026 speaks of membership from the date of joining for covered employees. We found no waiting period for seasonal staff, but confirm with your PF consultant.
Does retention allowance count as PF wages?
The Code's wage definition includes retaining allowance, if any. Ask your adviser how this applies to your wage board or standing order terms.
What is the PF wage ceiling now?
Rs 25,000 a month from 17 September 2026 under S.O. 5109(E). It replaced the Rs 15,000 figure.
Does professional tax apply to workers who earn only part of the year?
It depends on the state's slabs and rules. Test the pay each period against your state schedule, and confirm any annual or half-yearly basis with your tax office.
